Finally, you will learn what rights you have regarding your personal data.

The processing of personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (the “Regulation”).

Who manages your personal data?

The joint controllers of your personal data are myself, Ing. Miroslav Černý, ID No. 88270076, with place of business Konzumní 384/18, 736 01, Havířov, and Insightee s.r.o., ID No. 06982379, with registered office at Nádražní 344/23, Smíchov, 150 00 Praha 5, registered at the Municipal Court in Prague, Section C, Insert 292515 (hereinafter referred to as “Joint Controllers”).

1. Ordering services, courses or consultations

1. We process the following personal data in connection with your order:

  • first name, last name,
  • e-mail address,
  • phone number,
  • company ID / VAT ID,
  • address/location,
  • payment details,
  • order details and any other personal data you provide when placing an order,
  • personal data of other participants, if you have entered them.

2. If you have filled in the personal data of other course participants, you declare that you are authorized to register them.

3. We need to process this personal data in order to process your order and fulfil what we have agreed. Such processing of personal data is permitted by Article 6(1)(b) of the Regulation – the processing is necessary for the performance of the contract. In addition, we process this data for the purpose of recording the contract and in case a dispute arises between us.
For these reasons, we process the above personal data for a period of 10 years from the execution of the last part of the contract, unless another legal regulation requires us to keep the contractual documentation for a longer period. Such processing is possible on the basis of Article 6(1)(c) and (f) of the Regulation – the processing is necessary for compliance with a legal obligation and for the purposes of our legitimate interests.

4. As you are becoming our client by placing an order, we may send you BI news and other commercial communications to your email address, unless you opt-out of receiving such communications. This procedure is permitted by Section 7(3) of Act No. 480/2004 Coll., on Information Society Services. You can opt out of these communications at any time by any means, for example by sending an e-mail to consulting@mirekcerny.com with the wording “I refuse to receive commercial communications” or by clicking on the link in the commercial communication.

5. The processing of personal data is carried out by us, i.e. the Joint Data Controllers. The following processors or third parties also process personal data for us:

  • The web hosting provider, WEDOS, a.s.;
  • The Rocket Science Group, LLC;
  • Accounting software provider Fakturoid, Fakturoid s.r.o.;
  • Provider of accounting services, company Nastejnelodi.cz, s.r.o.;
  • SimpleShop service provider, Redbit s.r.o., company ID 24197190;
  • Other providers of processing software, services and applications, if any, which are not currently used by the Joint Controllers.

6. Personal data will not be transferred to third countries outside the EU.

2. Contact form

1. In case of your inquiry via the contact form, we process your following personal data:

  • name and surname,
  • email address,
  • phone number,
  • the text of the message,
  • IP address.

2. We process your name, surname, email address and telephone number in order to answer your enquiry. Such processing is permitted by Article 6(1)(b) of the Regulation. We will process this personal data for a period of 2 years, unless you give us consent to further processing or the communication results in a request for our services.

3. The IP address will be processed for the purpose of preventing attacks on the Joint Controllers’ servers or spam. This is permitted by Article 6(1)(f) of the Regulation.

4. The processing of personal data is carried out by the Joint Controllers. The following processors or third parties also process personal data for us:

  • The web hosting provider, WEDOS, a.s.;
  • Provider of the Akismet spam detector service, Automattic Inc.,
  • Gmail service provider, Google Inc.

3. Newsletter subscription

1. If you are interested in receiving news from the BI world and other interesting things and subscribe to our newsletter, we process your personal data as follows:

  • email address,
  • your name and surname, if you have filled them in.

2. Your email address, first and last name will be processed for inclusion in the database for the purpose of sending newsletters and commercial communications. This personal data may be processed on the basis of your consent. Such processing is permitted by Article 6(1)(a) of the Regulation.

3. Personal data will be processed for this purpose for a period of 3 years from the date of consent, unless you extend this period.

4. You give your explicit consent to the above processing. You can withdraw your consent at any time, for example by sending a letter or email to consulting@mirekcerny.com or by clicking on the link in the newsletter. If you withdraw your consent, we will stop sending you newsletters.

5. The processing of personal data is carried out by the Joint Controllers, but personal data may also be processed for them by the following processors:

  • The web hosting provider, WEDOS, a.s.;
  • The Rocket Science Group, LLC.
  • Alternatively, other providers of processing software, services and applications, but not currently used by the Joint Controllers.

4. Cookies

1. The websites www.mirekcerny.com and www.insightee.com use cookies, which are used for the following purposes:

  • measuring website traffic and generating statistics about visitor traffic and behaviour on the website;
  • the functioning of the website;
  • tailoring and targeting advertising.

2. The collection of cookies for the purpose of measuring traffic and generating statistics may be considered as processing of personal data. Such processing is possible on the basis of a legitimate reason – our legitimate interest – and is permitted by Article 6(1)(f) of the Regulation. These cookies are considered in the form of a bulk unit and in an anonymous form that does not allow the identification of an individual.

3. Advertising targeting cookies are processed on the basis of your consent, which is given by your browser settings. Consent to the collection of cookie data for marketing purposes can be withdrawn at any time by changing the settings of the relevant internet browser.

4. You can also use the website in a mode that does not allow the collection of data about the behaviour of visitors to the website – this mode can be set either in the settings in the cookie bar on our website, in the browser settings, or you can object to the collection of cookies that we carry out on the basis of our legitimate interest, in accordance with Article 21 of the Regulation. You can object by sending an email to consulting@mirekcerny.com. We will evaluate your objection without delay. We only store the cookies necessary for the functionality of the website for the time necessary for the functioning of the website. If you object to the processing of technical cookies, the full functionality and compatibility of the website cannot be guaranteed in this case.

5. The collected cookies are processed by other processors:

  • Google Analytics and Google Ads, operated by Google Inc. The cookies collected are subsequently processed by Google Inc. in accordance with its Privacy Policy, available at https://policies.google.com/privacy?hl=cs#nosharing.
  • by Meta in accordance with their Cookie Policy, available at https://www.facebook.com/policies/cookies/.

What rights do you have?

Under the Regulation, you have the following rights:

  • object to processing on the basis of our legitimate interest,
  • withdraw the consent you have given,
  • request information from us about what personal data we process, request a copy of the personal data we process,
  • request access to and have your data updated or corrected by us, or request a restriction on processing,
  • require us to erase that personal data, which we will do unless it is contrary to applicable law or our legitimate interests,
  • to data portability where the processing is automated by consent or for the performance of a contract,
  • to effective judicial protection if you believe that your rights under the Regulation have been infringed as a result of the processing of your personal data in breach of this Regulation,
  • lodge a complaint with the Data Protection Authority.
